Despite the historical and contemporary significance of the Sharia, it has not yet been possible to solve the puzzle of its origins. Whereas previous research has postulated a greater or lesser degree of endogenous Islamic development, the present study reaches a different conclusion, namely that at the end of the 8th century Muslim state lawyers in Baghdad codified an Islamic 0Imperial Law0, oriented strongly towards Roman-Byzantine law. It is part of an Islamic-Byzantine context, and can only be explained against this intercultural background.

Trotz der historischen und aktuellen Bedeutung der Scharia ist es bis heute nicht gelungen, das Rätsel ihrer Entstehung zu lösen. Während die bisherige Forschung eine mehr oder weniger endogen-islamische Entwicklung postuliert, führt die vorliegende Studie zu einem anderen Schluss: Ende des 8. Jahrhunderts kodifizierten muslimische Staatsjuristen in Bagdad ein islamisches „Reichsrecht0, das sich stark am römisch-byzantinischen Recht orientiert. Es ist Teil eines islamisch-byzantinischen Kontextes und lässt sich nur vor diesem interkulturellen Hintergrund erklären.
