    Content: Die Beteiligung staatlicher Rechtssubjekte an privatrechtlich organisierten Gesellschaften mit privatem Anteilsbesitz ist in vielen Bereichen staatlichen Handelns verbreitete Praxis. Diese sogenannten gemischtwirtschaftlichen Unternehmen nehmen fortgesetzt und planmäßig am Wirtschaftsverkehr teil, bieten Dienstleistungen gegenüber privaten und staatlichen Rechtssubjekten an und kooperieren mit diesen. Es stellt sich deshalb die Frage, welche Rechtsbindungen sie im Rahmen ihrer Unternehmenstätigkeit zu beachten haben. Über die rechtlichen Vorgaben und Grenzen wirtschaftlicher Tätigkeit des Staates besteht keine Einigkeit. So wird es bislang unterschiedlich beurteilt, ob und unter welchen Voraussetzungen gemischtwirtschaftliche Unternehmen an die staatliche Einheiten als Adressaten voraussetzenden Rechtssätze, die sogenannten Sonderbindungen des Staates, gebunden sind. Die Vielfalt der unterschiedlichen Begründungsansätze folgt nicht zuletzt daraus, daß die Frage nach dem Anwendungsbereich der Sonderbindungen die Qualifizierung des jeweiligen staatlichen Adressaten voraussetzt und über die Kriterien zur Zuordnung von Rechtssubjekten zum Bereich des Staatlichen keine Einigkeit herrscht. Die Qualifizierung staatlicher Rechtssubjekte kann nicht ohne Rekurs auf theoretische Vorstellungen vom Wesen staatlicher Organisation gelingen. Ziel des von Ariane Berger vorgeschlagenen normativen Ansatzes ist die Entwicklung von Fallgruppen, in denen gesetzliche und vertragliche Rechtssätze eindeutige Zuordnungen einzelner gemischtwirtschaftlicher Unternehmen zum Bereich des Staatlichen zulassen

    Content: The continuing development of implantable neural prostheses signals a new era in bioengineering and neuroscience research. This collection of essays outlines current advances in research on the intracranial implantation of devices that can communicate with the brain in order to restore sensory, motor, or cognitive functions. The contributors explore the creation of biologically realistic mathematical models of brain function, the production of microchips that incorporate those models, and the integration of microchip and brain function through neuron-silicon interfaces. Recent developments in understanding the computational and cognitive properties of the brain and rapid advances in biomedical and computer engineering both contribute to this cutting-edge research. The book first examines the development of sensory system prostheses -- cochlear, retinal, and visual implants -- as the best foundation for considering the extension of neural prostheses to the central brain region. The book then turns to the complexity of neural representations, offering, among other approaches to the topic, one of the few existing theoretical frameworks for modeling the hierarchical organization of neural systems. Next, it examines the challenges of designing and controlling the interface between neurons and silicon, considering the necessity for bidirectional communication and for multiyear duration of the implant. Finally, the book looks at hardware implementations and explores possible ways to achieve the complexity of neural function in hardware, including the use of VLSI and photonic technologies.

    Content: In recent years it has become much more accepted in Germany to consider aspects of the Second World War in which Germans were not perpetrators, but victims: the Allied bombing campaign, expulsions of 'ethnic' Germans, mass rapes of German women, and postwar internment and persecution. An explosion of literary fiction on these topics has accompanied this trend. Sebald's 'The Air War and Literature' and Grass's 'Crabwalk' are key texts, but there are many others; the great majority seek not to revise German responsibility for the Holocaust but to balance German victimhood and German perpetration. This book of essays is the first in English to examine closely the variety of these texts. An opening section on the 1950s - a decade of intense literary engagement with German victimhood before the focus shifted to German perpetration - provides context, drawing parallels but also noting differences between the immediate postwar period and today. The second section focuses on key texts written since the mid-1990s shifts in perspectives on the Nazi past, on perpetration and victimhood, on 'ordinary Germans,' and on the balance between historical empathy and condemnation.
