In der gegenwärtigen Debatte zur deutschen Asylpolitik gibt es Vorschläge, Asylsuchende an den Grenzen Deutschlands grundsätzlich oder zumindest teilweise zurückzuweisen. Dies soll etwa Menschen betreffen, die bereits in einem anderen Land der EU registriert wurden, wie auch Menschen, die über keine Papiere verfügen. Die vorgeschlagenen Zurückweisungen werden mitunter damit begründet, dass sie zur Wiederherstellung der bestehenden Rechtsordnung geboten seien. Tatsächlich ist es aber mit europa- und menschenrechtlichen Verpflichtungen nicht in Einklang zu bringen, Menschen, die einen Asylantrag stellen, an den Grenzen Deutschlands zurückzuweisen. Die bestehenden europa- und menschenrechtlichen Verpflichtungen können auch nicht durch bilaterale Abkommen mit anderen EU-Staaten modifiziert werden, sodass Deutschland Asylsuchende auch nicht auf der Grundlage bilateraler Abkommen an der Grenze zurückweisen dürfte.
