    Note: Warum ein Bautaschenbuch für Richter und Rechtsanwalte? Juristen haben Bauprozesse zu führen, obwohl sie keine Baufachleute sind. Bausachverständige schaffen den Richtern und Rechtsanwalten die fachlich qualifizierten Unterlagen. Diese sollen dem Juristen ermöglichen, Baumängel und Bauschäden selbst zu beurteilen, mehr nicht. Der Jurist und nicht der Bausachverständige führt den Prozeß. Aufgabe unserer Gerichte ist es, Recht zu sprechen. Wer aber will Recht sprechen über Gebautes, über Bauhandwerke, über Industriebetriebe oder Bauherren, wenn er vom Bauen selbst und von Bauschäden nichts oder zu wenig weiß? Zwei Fachleute sprechen zwei Fachsprachen. Sie verstehen einander kaum. Trotzdem muß der Jurist den Bausachverständigen verstehen. Kann er sonst einem Bauschaden auf den Grund gehen? Kann er sonst entscheiden, wesentliche Fehler am Bau von unwesentlichen trennen und Schäden richtig beurteilen? Kann sonst ein Richter über ein Verschulden gerecht urteilen? Der Jurist kann zwar kein Baufachmann sein und soll es auch nicht. Aber er muß sich darüber informieren können, wann, wie und wo Bauschäden entstehen, welche Möglichkeiten zu ihrer Beseitigung bestehen, ob und welcher Minderwert verbleibt. Hierzu wurde dieses Buch geschrieben. Es besteht aus zwei Teilen: Im 1.
