Abstract: The remarkable originality of Dos Passos's Manhattan Transfer (1925) has been long recognized. From Sinclair Lewis's early appreciative essay onwards, the novel's significant advance over Dos Passos's three previous novels, its break with constricting convention, and its technical boldness have been repeatedly noted. Dos Passos's broad concern remains that of the traditional realist–the heavily itemized portraiture of urban social life–but in Manhattan Transfer that portraiture is energized and given fresh impact by new modes of description and new principles of narrative structure. These innovations have customarily been traced to the influence of modernist experimentation in the novel, and Dos Passos's debts to James Joyce, Gertrude Stein and Marcel Proust have been established. Yet an explanation of Dos Passos's conception of form which confines itself to literary modernism alone must be regarded as incomplete. Dos Passos's heightened visual sense and the marked painterly and cinematic qualities of his work indicate that it is to the twentieth-century pioneers in the visual arts, as well as to the pioneers in fiction, that we must look for formative influences. Dos Passos enjoyed a lifelong interest in the visual arts. After Harvard he went to Spain to study architecture, and at one time as a young man he was unsure whether to choose fine art or literature as his main avenue of creative expression.

Abstract: In this paper, self-recorded interactions from two studies of verbal interaction in Denmark are analysed using key concepts from Erving Goffman's frame analysis and Don Zimmerman's theory of identities in talk. It is documented how the recorder is integrated into everyday interaction as soon as the informant in his or her capacity as temporary fieldworker has explained the reason for its being there and has obtained the permission from his or her partners to record them. In several excerpts ascribed identities and using the recorder as an addressee are used to create amusement and to exploit the possibilities for supplying the innocent overhearing researcher with new and shocking information. The question of language norms during recorded sessions was raised in conversations in both studies and the limits of privacy were brought up.

Abstract: This article aims to introduce the notion of panoptic structures as a way of theorizing how people strategically exploit the affordances of digital devices to expose other people's behavior. I argue that Foucault's notion of panopticism becomes relevant in new ways in social life as a consequence of the polymedia repertoires of networked individuals. Central here is the ability to store digital communication and repost it for selected audiences. The data I analyze here were collected from a group of students who had just entered the gymnasium (the Danish equivalent of high school). During the months of multi-sited, online and offline ethnography, a conflict occurred between two groups of students. During this conflict, a repeated activity involved students confronting students from the opposing group with screenshots of their earlier social media activities and doing so in front of larger audiences of other students. On this basis, I argue that a theory of such panoptic practices belongs in the sociolinguistic toolbox. (Panopticism, social media, conflict, polymedia repertoire, audience)*

Abstract: From photometric observations out to the tidal radii of the galaxies, we were able to identify hundreds of new carbon stars, to derive mean absolute magnitudes〈 Mi 〉, luminosity functions, and the spatial/radial distributions of the carbon stars in these galaxies. For each galaxy this new material will allow estimates of the tips of their RGBs to derive distance moduli, to derive C/M ratios of the AGB populations and bolometric magnitudes Mbol . At the end of our survey a comparison of all quantities of the late-type stars as a function of the properties of the host galaxies will be made possible.

Abstract: It has long been disputed whether a consumer under the Distance Selling Directive has the right to revoke a contract concluded as the result of an Internet auction. There is no doubt that contracts concluded by means of electronic trading platforms are to be qualified as distance selling contracts if there is a business-to-consumer-situation. Hence, at first glance, contracts entered into in the course of an Internet auction should be treated in the same manner so that consumers may exercise their right to revoke the contract. On the other hand, a right to revocation would hamper significantly an Internet auction because this form of trading depends on its character as a game and, thus, on the finality of the resulting contracts. If buyers are enabled to revoke their contracts after the end of an auction there would be no risk for a buyer in making the highest possible bid, thus rendering the auction a farce.

Abstract: Billions of Euros of turnover are generated every year from games of chance. The legal framework conditions regulating this branch of the economy vary significantly within the European Union. Whilst in many countries such as Germany the state has a dominating monopoly position, other Member States, such as Denmark, France and Italy, have made moves towards a consistent partial liberalisation. These different framework conditions lead to problems, increasingly so as the European internal market is otherwise growing closer together. This is especially evident in the area of online gambling which, due to the structure of this medium, is not restricted by national boundaries, but must nevertheless not constitute a legal no man's land. Against this background, it appears logical for the European Court of Justice (ECJ), on the occasion of the submission of cases by Member State courts pursuant to Art. 267 of the Treaty on the functioning of the European Union (TFEU) (previously Art. 234 EC), to repeatedly have called for the examination of national gambling regulations with regard to their compliance with Union law, as the ECJ's standing jurisdiction acknowledges that a (national) state monopoly for cross-border issues represents a violation of the freedom of establishment as set out in Art. 56 TFEU (previously Art. 49 EC) or the freedom of establishment as set out in Art. 49 TFEU (previously Art. 43 EC) respectively. Such restrictions of gambling activities may, however, be justified by matters of overriding general interest.

Abstract: Post-starburst galaxies (PSBGs) are systems that experienced a burst followed by a rapid quenching of star formation. However, it is still unclear what causes these events and what is the environmental role in the origin of PSBGs. To address this, we analysed sizes, morphologies, ages, and metallicities of PSBGs at 0.05 ≤ z ≤ 0.1 in groups and clusters of galaxies. We find a statistically significant excess of compact PSBGs in groups compared to a control sample of passive galaxies. Satellite PSBGs in groups tend to be more compact compared to their counterparts in clusters. Additionally, the PSBGs in groups have smaller T-type values and are likely to be found in inner group regions compared to PSBGs in clusters. Our results are compatible with dissipative wet merger events being an important mechanism responsible for the origin of PSBGs in groups, but other – less dissipative – processes may be producing PSBGs in cluster environments.
