    Abstract: Article 7 paragraph (2) of the Law Number 24 Year 2007 concerning Disaster Management (UUPB) stipulates that the establishment of a disaster emergency status must contain indicators that include the number of victims, property loss, the damage of the infrastructure and facilities, the extent to which an area is affected by the disaster and the socio-economic impacts that arise. Paragraph (3) of the article states that further provisions regarding the establishment of the status and the level of the disaster are regulated through a Presidential Regulation. However, the Presidential Regulation has not yet been issued while the Letter of Decision on the Disaster Emergency Status continues to be published, which causes legal uncertainty in its implementation. Hence this article investigates the legal mechanism in determining a disaster emergency status that guarantees legal certainty, its legal implications, and steps the (central) Government and the Regional Government should take in dealing with such legal implications. The research method employed in this study is the juridical normative research. Research on disaster legislation, especially in determining disaster emergency status, has not yet demonstrated legal certainty. This is due to the absence of legal mechanisms and positive legal formalities that are built from legal facts that lead to multiple interpretations and to legal disputes. The absence of the Presidential Regulation (Perpres) as a UUPB manifestation for determining the emergency status of a disaster as stipulated by autonomous provinces/districts (Decree) has contributed to the potential arbitrary use of state funds. Therefore, the Presidential regulation is urgently required.

    Abstract: In 2007, the Companies Act (Amendment Act) was passed. It included a new provision introducing statutory derivative action that allows action to be brought on behalf of the company by certain ‘complainants’. This article highlights certain gaps in the law or the potential misconception that could arise in understanding the new statutory derivative action. Decisions from the UK and other comparable common law jurisdictions that have codified the statutory derivative action discussing the scope of the statutory derivate action will be examined to shed some light on the newly introduced section 181A of Malaysian Companies Act 1965 with the intention of ascertaining whether the principles in some of these decisions could be introduced into Malaysian company law jurisprudence.

    Abstract: The impact of mental illness is profound. This qualitative study aims to explore the impact experienced by family caregivers who provide care to relatives with mental illness. A total of 15 family caregivers from the state of Kedah in Malaysia participated in this study. The findings indicated that the family caregivers experienced four types of negative impact, including financial burdens and social, psychological and physical health. This study suggests that the family caregivers should engage in support groups to obtain emotional support and the required information from other caregivers who have similar experiences in caring for individuals with mental illness.

    Abstract: This paper aims to analyze the issues concerning the implementation of binding precedent in Malaysian cases, and propose a re-evaluation of the binding precedent doctrine. The qualitative approach was employed to indicate the issues related to the doctrine of binding precedent by analyzing relevant cases. These cases were selected to propose the re-evaluation of the binding precedent doctrine as practiced by the Malaysian dual-judicial system. The main issue to be discussed regarding the doctrine of binding precedent is interference by the Civil Court on Islamic matters and Syariah Court decisions, which lead to inconsistency in judgments, even after the amendment of Article 121(1A) of the Federal Constitution. This study proposes that the application of binding precedent should be re-evaluated to ensure that the principles of justice are upheld. Court judges should decide cases based on merit, and only use previous judgments as guidance for present and future cases.

    Abstract: The village has a lot of potential to improve the welfare of the community, such as Sodong coastal tourism in Cilacap which can be developed with Community Based Tourism. The study used descriptive quantitative methods and analysis with data collection through questionnaires, interviews, focus group discussions, observation, and documentation. Respondents were determined by a total sample of 120 people consisting of internal parties, namely the village government, tourism administrators, fishermen, farmers, and traders using Random Sampling of as many as 60 people and 60 people from outside visitors using Accidental Sampling. The research took place in Sodong Beach, Karangbenda Village, Cilacap Regency, Central Java Province of  Indonesia. The results showed that the development of coastal tourism requires improving facilities and infrastructure such as electricity networks, street lighting, trash cans, and information centers. Then it requires a joint commitment to tourism managers and owners, a network of cooperation, and a more proactive government role with policies, budgets, and programs to make coastal tourism based on agribusiness and community participation.

    Abstract: Tourism villages are community-based and sustainable development, aiming to improve people's welfare, environmental and cultural sustainability, and improve the quality of human resources. Efforts to increase tourist visits to tourist villages by conducting marketing promotions. The key to marketing promotion is proper communication with potential tourists using the right media. The purpose of this study was to analyze the application of integrated marketing communication for tourism village marketing promotions. The theory used is Robyn Blakeman's integrated marketing communication theory. This study uses a mixed method with data collection through questionnaires, observation, in-depth interviews, and Focus Group Discussion (FGD). Data were analyzed using quantitative descriptive analysis and qualitative analysis. The research informants came from elements of the village government, tourism village managers, women's groups, and business groups. The research location was in Cikakak Village, Wangon District, Banyumas Regency, Central Java Province, Indonesia. The research results show: (1) Media have been implemented, with different application intensities. (2) Promotional media that are often or always used include public relations, social media, the internet, telephone and SMS, alternative media, and personal selling. (3) Promotional media that are rarely used include advertising, billboards, direct marketing, and sales promotion media that are rarely used include advertising, billboards, direct marketing, and sales promotion.

    Abstract: The development of information and communication technology in the era of globalization, democratization, and decentralization has become a necessity as well as a challenge, especially for local governments in the development of communication for public services and community empowerment. The research used a qualitative case study method, with data collection through documentation, interviews, observations, and Focus Group Discussions (FGD). The research subjects were chosen purposively, namely local governments in four district governments in the southern region of Central Java in Indonesia, academics, observers, and digital media practitioners. The study used Cross Case Analysis to find the diversity, uniqueness, and depth of cases. The results of the study indicate that (1) Public services are important and strategic to be implemented through information and communication technology media in the form of e-Government to improve public services that are efficient, effective, participatory, responsive, and have transparency of information as well as budget accountability and implementation of development programs. (2) The government needs to anticipate the information technology gap so that it requires digital media literacy in improving the competence of human resources in government institutions, educational institutions, and social also business economics.

    Abstract: Current reform concerning directors’ remuneration relies on improving legal rules and self-regulation to minimise expropriation of minority shareholders. These have prominently focussed on empowering shareholders. Nonetheless, it is unclear as to the extent these reform proposals are compatible within the concentrated shareholding structure. Some of the reforms taking place in developed countries are suited for dispersed shareholding structure and thus transplanting them to emerging economies with concentrated shareholders may be ineffective. Malaysia poses an interesting case study, especially to countries with similar ownership structure as the concentrated shareholding structure raises different agency problems. The issue of protection of minority shareholder rights and the prevention of abuse of the controlling power by paying excessive remuneration to the executives is therefore a subject of due consideration in Malaysia and countries with similar shareholding structures. This article recommends that Malaysia and other emerging countries look into encouraging limited shareholder empowerment in tandem with laws.
