Premier terme de la plupart des dictionnaires juridiques, l'abandon ne connaît pour autant aucune définition unitaire. Aucun auteur ne s'est penché de près sur cette notion indéterminée, découragé très probablement tant par l'amplitude de son champ d'application que par les diverses natures juridiques qui lui sont conférées. Méconnue, ignorée, incomprise, et souvent, galvaudée, la notion d'abandon invite à s'interroger sur sa détermination juridique. La première partie de l'étude tend à promouvoir une conception unitaire de cette notion dans le seul dessein de faire la lumière sur une définition précise de l'abandon en droit privé. Pour ce faire, il est proposé, d'une part, de rejeter une conception extensive de la notion d'abandon, en rompant avec toutes les situations juridiques qui sont improprement appelées "abandon", et, d'autre part, d'adopter une conception restrictive de cette notion, en reconnaissant qu'il existe une faculté d'abandon restreinte aux enfants avec filiation établie et connue et aux biens meubles corporels appropriés et qu'il s'agit, au regard des hypothèses recensées, d'un acte juridique. Plus précisément, l'abandon sera défini comme un acte juridique unilatéral par lequel l'auteur réalise un fait matériel de remise en vue d'abdiquer un droit qui le lie à l'objet de l'abandon. La seconde partie de la thèse met en exergue la réception de la conception unitaire de la notion d'abandon par le droit privé. L'étude des conditions de réalisation de l'abandon révèle de l'impérieuse nécessité d'une réglementation de cet acte, et ce, quel que soit son domaine. Aussi chaque abandon doit-il être réalisé dans un lieu destiné à cet effet. Le régime juridique de l'abandon révèle aussi une certaine autonomie de celui-ci vis-à-vis d'autres actes juridiques unilatéraux et abdicatifs, dans la mesure où, d'une part, l'extinction du droit abdiqué peut être immédiate ou différée, d'autre part, des conséquences juridiques se produiront à l'égard de l'objet de l'abandon. Enfin, l'étude porte sur la sanction de l'abandon, dès lors qu'il a été réalisé en dehors d'un cadre réglementaire

First term of most legal dictionnaries, abandonment does not, so far, have a unified definition. No author has looked closely at this indeterminate (vague) concept, probably discouraged by both the magnitude of its scope and the various legal characteristics which are conferred to it. Misunderstood, ignored, misunderstood, and often wrongly used, the concept of abandonment raises questions about its legal determination. The first part of the study tends to promote a unified conception of this notion for the sole purpose of shedding light on a precise definiton of abandonment in private law. To achieve this, it is suggested, firstly, to reject a broad interpretation of the concept of abandonment, by delinking with all legal situations which are wrongly called "abandonment", and, secondly, to adopt a restrictive approach of this concept, by recognizing that there is a possibility of abandonment restricted to children with established and known filiation and to tangible appropriated objects and that it is, with regards to the identified assumptions, a legal act. More specifically, abandonment will be defined as a unilateral legal act by which the author performs a material act of remittance in view of waiving a right that binds him to the object of the abandonment. The second part of the thesis highlights the acceptance of the unified conception of the notion of abandonment by private law. The study of the conditions for realization of abandonment reveals the urgent need for the regulation of this act, notwithstanding the field in which it is performed. An abandonment must only be made in a place intended for that purpose. The legal mechanism of abandonment also reveals that it differs from other legal unilateral acts of abdication, to the extent that, firstly, the extinguishment of the right may be surrendered immediately or may be deferred, and secondly, the legal consequences will occur with respect to the object of the abandonment. Finally, the study focuses on the punishment for abandonment, when it was made outside a regulatory framework
