Content: By conducting a comparative study of Germany and Korea, this book addresses the question of when the characteristics or behavior of company directors, employees or agents, such as dishonesty or malice, can be attributed to legal persons.It first explains what can be regarded as a natural person’s knowledge. Afterwards, the author considers section 166 of the German civil code and section 116 of the Korean civil code as bases for attributing such knowledge and reveals their limits.Next, he deals with ruling out attributing such knowledge in the case of a dishonest third party who does not deserve protection. In particular, he discusses the question of whether and to what extent the principles of abusing authority can be applied in cases in which attribution of knowledge is abused.Finally, this work examines the legal character of the obligation to engage in the lawful organization of knowledge, and the question of what the concrete terms of this obligation must be.

Content: Die Arbeit behandelt die Frage der Wissenszurechnung bei juristischen Personen mit rechtsvergleichenden Hinweisen zum koreanischen Recht. Ausgangspunkt der Untersuchung bildet die Frage, was als Wissen einer natürlichen, für die juristische Person handelnden Person anzusehen ist. Sodann werden § 166 BGB sowie § 116 KZGB als Wissenszurechnungsgrundlage betrachtet und ihre Grenzen aufgezeigt. Zudem geht der Autor auf den Ausschluss der Wissenszurechnung aufgrund fehlender Schutzwürdigkeit des unredlichen Dritten ein. Hier wird vor allem die Frage erörtert, ob und inwieweit die Grundsätze zum Missbrauch der Vollmacht auf Fälle des missbräuchlichen Ausnutzens der Wissenszurechnung entsprechend anzuwenden sind. Schließlich wird in dieser Arbeit untersucht, welchen rechtlichen Charakter die vom BGH herangezogene Pflicht zur ordnungsgemäßen Wissensorganisation hat und welche konkreten Inhalte die wissensbezogene Organisationspflicht haben muss.

Content: When does a reigning great power of the international system supplement military containment of a challenging power by restricting its economic exchanges with that state? Scholars of great power politics have traditionally focused on examining a reigning power's military containment of a challenging power. In direct contrast, Compound Containment demonstrates that these conventional studies are flawed without a sound understanding of the multilayered aspects of containment strategy in great power politics. Since economic capacity and military power are intimately linked to one another, countering a challenging power requires addressing both economic and military dimensions. Nonetheless, this nexus of security and economy in a reigning power's response to a challenging power cannot be explained by traditional theories that dominate research in international security. Author Dong Jung Kim fills a gap in the scholarship on great power competition by investigating when a reigning power will make its military containment of a challenging power "compound" by simultaneously employing restrictive economic measures. Its main theoretical claims are corroborated by an analysis of key historical cases of reigning power-challenging power competition. This book also offers policy prescriptions for the United States by examining whether the United States is in a position to complement military containment of China with restrictive economic measures
