Gegenstand der Untersuchung ist das Zusammentreffen von zusammengesetztem Delikt und Einwilligung. Aus einer Betrachtung der historisch gewachsenen Begriffe strafrechtlichen Unrechts ergibt sich der - verschiedene Inhalte umfassende - Begriff der Rechtsgutsverletzung als deren gemeinsamer Bestandteil. Diese Gemeinsamkeit ermöglicht die Bildung eines insofern allgemeinen Begriffs des "zusammengesetzten Delikts", der sodann anhand des Besonderen Teils des StGB exemplarisch erprobt wird. Es stellt sich heraus, daß sowohl Individual- als auch Gemeinschaftsrechtsgüter verletzende zusammengesetzte Delikte existieren. Dieser Befund führt zu der Frage der Behandlung einer "Teilrechtfertigung" aufgrund teilweiser Einwilligung im weiteren Sinn. Im Ergebnis ist eine Bestrafung wegen eines zusammengesetzten Delikts in solchen Fällen nicht möglich. Keine der beiden hierzu kumulativ erforderlichen Prämissen hält einer kritischen Nachprüfung stand: So ist zum einen als Bezugspunkt des Rechtswidrigkeitsurteils wie sonst die einzelne Rechtsgutsverletzung maßgeblich. Zum anderen ist die Einordnung der Einwilligung als tatbestandsausschließend vorzugswürdig.
