Peter Dieterich untersucht und vergleicht das verfassungsrechtliche Postulat der »Systemgerechtigkeit« und die unionsrechtliche Figur der »Kohärenz«. Insgesamt führt die Arbeit die aufgeladene Debatte um legislative Rationalitätsgebote auf ihren legitimen normativen Kern zurück. Dabei belegt die Analyse der Begründungen eines Gebots systemgerechter Normgebung (v.a. Gleichheitssatz, Rechtsstaatsprinzip, Verhältnismäßigkeitsgrundsatz), dass diesem nur ein äußerst schmaler Anwendungsbereich bleibt: Es steht allein evident widersprüchlichen Rechtfertigungen für Grundrechtseingriffe entgegen. -- Für das unionsrechtliche Kohärenzprinzip können bei der Rechtfertigung von Grundfreiheitseingriffen zwei Funktionen identifiziert werden: Als Rechtfertigungsgrund bleibt es auf eine Rolle als qualifiziertes (vornehmlich steuerrechtliches) Kompensationsargument beschränkt, als Rechtfertigungsgrenze bildet es eine legitime Verschärfung der Geeignetheitsprüfung, die weitgehend mit der verfassungsrechtlichen Systembindung übereinstimmt.
