Angesichts der immensen Bedeutung sozialrechtlicher Leistungserbringungen kommt der Klärung der Frage, ob und ggf. in welchem Ausmaß die Sozialleistungsträger an das europäisch geprägte Kartellvergaberecht gebunden sind, erhebliche Relevanz zu. Der Autor führt den Nachweis, dass das Kartellvergaberecht keine Anwendung auf Sozialleistungsträger findet. Das Werk nimmt eine Gesamtbetrachtung der Leistungserbringung durch Dritte im Sozialrecht vor und zeigt auf, dass Sozialleistungsträger als „öffentliche Auftraggeber“ i.S.d. § 98 GWB und alle potentiellen sozialrechtlichen Leistungserbringer als „Unternehmen“ i.S.d. § 99 Abs. 1 GWB anzusehen sind, dass (koordinationsrechtliche) öffentlich-rechtliche Verträge und Verwaltungsakte gleichermaßen dem Vertragsbegriff des § 99 Abs. 1 GWB unterfallen und dass auch eine Beschaffungstätigkeit der Träger vorliegt. Der Anwendungsbereich des Kartellvergaberechts ist letztlich mangels Entgeltlichkeit der Beschaffungsverträge nicht eröffnet, wobei die Entgeltlichkeit nicht schon mit dem Hinweis darauf verneint werden kann, dass in den Verträgen zwischen Sozialleistungsträgern und Sozialleistungserbringern Konzessionsverträge zu sehen seien
