    Kurzfassung: This article addresses the dilemmas and compromises in legal practice around the issue of child marriage in Indonesia. Although the government set development goals that include ending child marriage and complying with human rights standard, it is facing considerable resistance. We researched the state legal system and law in practice to understand this resistance, finding that: (1) law-making in family law involves conflict between progressive and conservative ideas; (2) consequently there is friction within current family law and laws regarding human rights; (3) judges use their discretion to achieve compromises between state laws and local norms; and (4) state law is creatively interpreted and applied at village level. The resistance at all these levels, arising from the religious concerns of conservative Muslims in a rapidly modernizing Indonesian society, is a formidable obstacle for the government to achieve its development goals. Adolescent sexuality is at the heart of these tensions.

    Kurzfassung: AbstractAlthough the prevalence of child marriage in Indonesia is still high, adat law studies on child marriage have not received as much attention as land-related studies. This research concerning a century of political debate on child marriage proves that child marriage can only be understood if examined from the perspective of the dynamic relationship between national law, religious law, and adat law. A comparison between the results of an antrophological case study on West Java (Sundanese and Islam) and a historical case study on North Sumatra (Toba Batak and Christian) shows that the legal culture of the community and the role of religious leaders are important determinants of the acceptance or rejection of child marriage. IntisariMeskipun prevalensi perkawinan anak di Indonesia masih tinggi, studi hukum adat terhadap perkawinan anak belum mendapat perhatian sebesar studi terkait tanah. Penelitian tentang satu abad debat politik tentang perkawinan anak ini membuktikan bahwa perkawinan anak hanya dapat dipahami bila diteliti dari sudut dinamika antara hukum negara, hukum agama dan hukum adat. Perbandingan studi kasus penelitian antropologi di Jawa Barat (suku Sunda, Islam) dan studi kasus sejarah di Sumatra Utara (suku Batak Toba, Kristen) menunjukkan bahwa budaya hukum masyarakat dan peran pemimpin agama adalah faktor penting penentu penerimaan atau penolakaan perkawinan anak.

    Kurzfassung: What makes child marriage an option for girls and their relatives in this present time? How and why does it happen in an average village in Sukabumi, West Java? Kabupaten Sukabumi is one of the districts in West Java that has a high number of child marriages, especially in the villages in the periphery. The selected research village is not a child marriage hot-spot compared to provincial standards. With an incidence2 of 32 % for marriage under 18 of ever married women between 20-24 it is slightly higher than the provincial average of 30.7%3 . Compared to the Indonesian average of 17% for marriage under 18 it is much higher4 . The choice to do research in one village enables us to look in detail at different aspects of child marriage and intersectionality in the same setting. The research is based on 28 qualitative in-depth case-studies, combined with a census of all households with 20-24-year-old male and female members and supporting interviews and observations. Fieldwork is about to be finalised, other parts of the research are still ongoing. Sketches of six cases – five girls and one boy – show the diversity and complexity of child marriage. The article discusses the potential agency of young people vis-a-vis their parents/elders, from self-realised marriage to forced marriage. It confirms the role of common causes like the lack of control of girls’s sexuality and the fear of zina, and poor access to education and health when it comes to pregnancies, but questions the role of poverty as a direct reason of child marriage. Every case seems to be a particular combination of causes based on morality and religion, the composition of households, parental care and upbringing, the access girls have to formal and religious education, including sexual education, and to the local labour market. Gender and age are crosscutting hierarchies with girls at the most powerless side of the equation.
