Abstract:
Sur le plan du droit matériel, l’Allemagne se dirige vers une assimilation de la situation des couples homosexuels à celle des couples hétérosexuels. En 2001, une loi a introduit le partenariat enregistré exclusivement pour les couples du même sexe ; cette loi est conçue sur le modèle des règles applicables au mariage. Pourtant en droit international privé, la solution adoptée par le droit allemand est assez restrictive. Selon l’opinion majoritaire, il convient d’appliquer, dans un premier temps, le droit de l’Etat où le mariage homosexuel a été conclu ; mais dans un second temps, ce mariage étranger ne peut pas excéder les effets d’un partenariat enregistré allemand. Par conséquent, un tel mariage valablement conclu à l’étranger est « dévalué » et converti en partenariat enregistré. Il est douteux que cette « dévaluation » soit conforme au droit de l’Union européenne, surtout au droit de circuler et de séjourner librement sur le territoire de tous les Etats membres, garanti par l’article 21 TFUE. Selon l’auteur, il est souhaitable d’éliminer l’actuelle dévaluation des mariages homosexuels en droit international privé allemand. De plus, il propose l’instauration d’un « vrai » mariage homosexuel en droit allemand.
