Abstract:
Der Beitrag würdigt das Urteil des BVerfG zur Zulässigkeit und zu den verfassungsrechtlichen Grenzen der so genannten Online-Durchsuchung. In Auseinandersetzung mit den wichtigsten der bis Mitte September 2008 erschienenen Äußerungen des Schrifttums zu diesem Urteil wird dargestellt, dass sich die Entscheidung in der Kontinuität der bisherigen Rechtsprechung des Gerichts befindet und mit dem Grundrecht auf Gewährleistung der Vertraulichkeit und Integrität informationstechnischer Systeme zwar kein neues Grundrecht geschaffen, gleichwohl aber mit einer neuen Ausformung des allgemeinen Persönlichkeitsrechts einen weiteren wichtigen Pfeiler zum Schutz der Persönlichkeitsentfaltung der Bürger gesetzt hat.
