Abstract:
The author begins with an analysis of the import of various research projects on ‚Knowledge and Opinion about Law‘ ( KOL). She continues by arguing that the KOL-authors, owing to an inadequate formulation of the problem, are evasive on the question of objectives relating to legal policy and are for the most part committed to a technocratic ideology. Although it is now doubtful whether this research, owing to its inadequate theoretical base, is useful at all for technocratic purposes, it is not without effect: By making inquiries and by giving publicity to public opinion on law, legal facts are created that serve to legitimate, with respect to the politics of the law, the status quo. KOL-research has a legitimation function similar to that of etiological criminology. In her last section the author provides a sketch of the theoretical framework of the research projects carried out in Saarbrücken, a framework that expressly attributes the KOL-research to the context of legitimation.
