Welche Aufgaben und Grenzen kommen der Privatautonomie in den Rechtsordnungen Ostasiens und Deutschlands zu? Das ist die Leitfrage dieses Sammelbands. Der Bogen spannt sich von rechtstheoretischen und rechtshistorischen Untersuchungen zum Staats- und Völkerrecht, vom Vertrags- zum Persönlichkeit-, Namens-, Verbraucherschutz- und Eigentumsrecht, vom Arbeits- zum Wirtschaftsrecht. Besonders fruchtbar ist dabei der Vergleich der ostasiatischen und der deutschen Rechtsordnungen. Einerseits verlangen Rechtsfragen, die moderne Gesellschaften verschiedener Kulturräume aufwerfen, ähnliche Freiräume und Schranken individueller Rechtssetzung; andererseits bestimmen die Traditionen statusgeprägter Gesellschaften oder das Erbe kommunistischer Ordnungsvorstellungen auch weiterhin die Rolle, die man der Privatautonomie zuspricht. So ist in Deutschland die Privatautonomie im Laufe des 20.
