Der Europäische Rat der Europäischen Gemeinschaft hat mit dem Artikel 100a der Einheitlichen Europäischen Akte ein Instrument geschaffen, das die Vereinbarkeit zweier Zielsetzungen ermöglichen soll: 1. Schaffung des gemeinsamen Binnenmarktes und 2. Sicherung des Umweltschutzes, der Gesundheit und der Arbeitsumwelt. Die Formulierung des Artikels läßt unterschiedliche Interpretationen zu, insbesondere im Problembereich der Gültigkeit von einzelstaatlichen Bestimmungen und Rechtsvorschriften, insofern wird sich erst in der zukünftigen Kooperation erweisen, ob die Einheitliche Europäische Akte der übergeordneten Zielsetzung gerecht werden kann.
