Eine an der freiheitlichen Systematik des Grundgesetzes orientierte Auslegung der Vorschriften zum Parteien- und Vereinsverbot – dieses Ziel verfolgt der Autor ausgehend von einer Auseinandersetzung mit den vermeintlichen „Lehren aus Weimar“ und den Urteilen des BVerfG zum Verbot von SRP und KPD. Er entwickelt demgegenüber aus der freiheitlichen demokratischen Grundordnung und ihren Bezugspunkten im Verfassungstext eine Auslegung der Verbotsnormen, die die Bedeutung der politischen Freiheit und der Verhältnismäßigkeit in den Vordergrund stellt. Hiernach können Parteien und Vereine nur verboten werden, wenn sie eine substanzielle Gefahr für eines der von den Verbotsnormen geschützten Rechtsgüter darstellen. Die Untersuchung wird abgerundet durch eine Gegenüberstellung der deutschen und der englischen Verbotsbestimmungen, die unter anderem zeigt, dass ein gewisses Maß an Gelassenheit auch gegenüber dem politischen Extremismus keine Schwäche, sondern eine Stärke der Demokratie ist
