Der Gesetzgeber hat mit Einführung des Übergangsmandates in § 21a BetrVG die Forderungen der Richtlinie 2001/23/EG zumindest für den Bereich des Betriebsverfassungsgesetzes umgesetzt. Gleichzeitig hat er damit den langen Streit über dessen Existenz endgültig beendet. Ausgehend von den Forderungen der Richtlinie 2001/23/EG untersucht die Arbeit, welche europarechtlichen Anforderungen an das Übergangsmandat an sich zu stellen sind. Weiter wird die Umsetzung dieser Vorgaben durch den nationalen Gesetzgeber in § 21a BetrVG geprüft. Dabei nimmt der Autor zu noch offenen Fragen wie dem Bestehen eines Übergangsmandates bei Eingliederungen Stellung und bietet praxisnahe Lösungen an. Die Richtlinie 2001/23/EG gilt neben dem Betriebsrat auch für die weiteren betrieblichen Arbeitnehmervertretungen. Daher geht die Arbeit auch der Frage nach, inwieweit der Bundes- und die Landesgesetzgeber bereits Übergangsmandate für die Personalräte, insbesondere bei Privatisierungen geschaffen haben. Ein Augenmerk liegt dabei auf der Frage, welche Folgen etwaig bestehende Umsetzungsdefizite haben. Schließlich beschäftigt sich die Arbeit mit den Auswirkungen der Richtlinie auf die kirchlichen Mitarbeitervertretungen.
