Jedes Jahr erreichen zahlreiche Verfassungsbeschwerden Strafgefangener das Bundesverfassungsgericht, dessen einschlägige Rechtsprechung weithin Anerkennung erfahren hat. Angesichts dessen ist es zentrales Anliegen dieser Arbeit, die Bedeutung des höchsten deutschen Gerichtes für den Bereich des Strafvollzuges näher zu untersuchen. Zu diesem Zweck hat Mario Bachmann erstmals alle veröffentlichten Entscheidungen des Bundesverfassungsgerichtes zum Strafvollzug analysiert und insgesamt 14 verschiedenen Themenfeldern (u.a. Vollzugslockerungen, Unterbringung, Rechts- und Datenschutz) zugeordnet. Für jeden dieser Bereiche werden zunächst die Kernaussagen der Karlsruher Richterinnen und Richter herausgearbeitet und sodann einer materiellen und prozessualen Entscheidungskritik unterzogen. Im Anschluss daran erfolgt jeweils eine Einordnung der zentralen verfassungsgerichtlichen Positionen in den zeitgeschichtlichen Kontext. Die Untersuchung ist ein Wegweiser für alle, die einen verfassungskonformen Strafvollzug zu gewährleisten haben oder aus anderen Gründen mit dieser Materie befasst sind. -- Ausgezeichnet mit dem CBH-Promotionspreis 2015 der Rechtswissenschaftlichen Fakultät der Universität zu Köln.
