Das zentrale Thema dieses Werkes ist die Auslegung des Art. 3 EMRK durch den Europäischen Gerichtshof für Menschenrechte. Die Analyse der Gesetzesanwendung zeigt eine zunehmend extensive Begriffsauslegung. So wurde die Norm in den letzten Jahrzehnten nicht nur auf zahlreiche neue Fallkonstellationen, insbesondere auch auf sog. Non-Refoulement-Fälle, angewendet, sondern bildete in jüngerer Rechtsprechung auch den Schwerpunkt gerichtlicher Piloturteile. Durch die Vorgabe konkreter Beweisregeln für die Behandlung eines Verstoßes gegen Art. 3 EMRK im Rahmen des Art. 6 EMRK hat der EGMR zudem seine Kompetenzen deutlich ausgeweitet. Das Buch untersucht, inwiefern diese Entwicklungen eine Einschränkung vertragsstaatlicher Souveränität zur Folge haben und ob diese ggf. durch den Schutz der Menschenwürde gerechtfertigt sein könnte. Darüber hinaus wird die Notwendigkeit einer absoluten Geltung des Artikels erörtert.
