Mit langer Tradition versucht das Datenschutzrecht, einen Ausgleich zwischen den Interessen der an einer Datenverarbeitung beteiligten Akteure herzustellen. Die Arbeit untersucht, ob und inwieweit dies unter den Voraussetzungen der neuen EU-Datenschutzgrundverordnung im Zusammenhang mit der Verarbeitung personenbezogener Daten im Rahmen der Nutzung sozialer Online-Netzwerke gelingen kann. Dabei werden zunächst herkömmliche Theorien der Abwägung umrissen, die Arbeit folgt sodann aber einem pragmatischen, funktionell orientierten Ansatz, welcher die vom Gesetzgeber implementierten Tatbestände als Ausgleichsinstrumente begreift und deren Funktionsweise untersucht und bewertet. So durchdringt die Arbeit zunächst das datenschutzrechtliche Ausgleichsprinzip im Allgemeinen, indem sie Kategorien von Abwägungswerkzeugen (Abwägungsbelange, -mechanismen und -kriterien), deren Eigenschaften und Funktionen im Rahmen des Abwägungsvorgangs beschreibt. Anschließend werden die besonderen Voraussetzungen der Netzwerkumgebung herausgearbeitet. Die Einbeziehung dieser speziellen Voraussetzungen gestattet es sodann, im Einzelnen zu analysieren, wie und warum die vom Gesetzgeber implementierte Ausgleichsmechanik im speziellen Kontext sozialer Medien nur eingeschränkt wirken kann. / »Balancing Privacy« -- The doctoral thesis analyses the principles of data protection law with regard to the context of social networks. It determines and describes, from a functional perspective, the legislative tools used by the European Data Protection Regulation and European courts to implement and enact the general principle of balancing. Subsequently, it outlines the specific preconditions that characterise the environment of social networks. Finally, by combining these findings, it investigates to what extent the balancing tools are impacted, altered or even restricted when applied to the processing of data in the specific context of social networks.
