Im Laufe der Zeit verwendete man sie zur Durchsetzung von Verzögerungsschäden, gewährte sie bei bürgschaftsähnlichen Abreden, sah sie als probates Mittel zur Überwindung des schuldrechtlichen Typenzwangs und als Grundlage für die Haftung aus einem Wechsel. Das römische Schuldkonstitut liegt im Schnittpunkt von Haftungsrecht, Zivilprozessrecht, Schuldversprechen, Interzession, Bürgschaft, Schuldbeitritt, Novation und weiteren Instituten und Systembegriffen. Die Arbeit beleuchtet in einem historischen Querschnitt von den Anfängen der Klage in der römischen Republik bis in die Moderne nicht nur die Entstehung der Klage und die dogmatische Behandlung des zugrundeliegenden Edikts durch die klassischen römischen Juristen, sondern auch den Umgang der Späteren mit diesem nach der Abkehr vom Formularverfahren an sich obsolet gewordenen Prozessmittel.
