Le Tribunal pénal international pour le Rwanda a été créé dans l'optique de juger les auteurs présumés des violations du droit international humanitaire qui ont été commises au Rwanda en 1994. Le préambule de la Résolution 955 du Conseil de sécurité des Nations Unies qui est à l'origine de cette juridiction, précise que l'avènement de la justice pénale internationale pour le Rwanda a été pensé dans l'optique de la voir contribuer à la paix et à la réconciliation nationale. Quinze ans après sa création, l'exercice de la fonction juridictionnelle, à travers la protection des accusés sous l'angle du procès équitable, et l'établissement de leur responsabilité pénale internationale, n'a pas pour autant permis la réalisation de ces objectifs politiques. La raison principale réside dans le fait que l'architecture du procès pénal international se prête peu à la réalisation d'un tel dessein politique, notamment à travers la fonction de la sanction, qui ne vise que la fonction rétributive et non réhabilitative, et l'absence de la victime comme partenaire dans une entreprise qui a été créée d'abord pour elle, et ce, au nom des droits de l'homme. De même, l'approche progressiste, bien présente dans l'interprétation des règles applicables, influencée, par ailleurs, par les considérations politiques (diplomatiques) n'a pas permis à ce Tribunal de s'exprimer comme une véritable juridiction, notamment à travers la fonction de protection des accusés. Elle montre ainsi les difficultés qu'a la juridiction pénale internationale de s'extirper des formalismes répressifs du fait de son caractère international, sans le risque de dénaturer son aspect juridictionnel, et par conséquent répressif.

The International Criminal Tribunal for Rwanda in appearance created to try to prosecute perpetrators of violations of international humanitarian law which were committed in Rwanda in 1994. The preamble of Resolution 955 of the Security Council United Nations, which is the source of that court, said that this main organ of the United Nations was convinced that the advent of international criminal justice for Rwanda would contribute to peace and national reconciliation. Fifteen years after its creation, the exercise of the judicial function, by protecting the accused in terms of fair trial, and the establishment of their international criminal responsibility, does not therefore allow these political objectives. The main reason lies in the fact that the architecture of international criminal trials takes part not much in the achievement of such a political design policy. Includes through the function of the penalty, which applies only to the retributive function and not rehabilitative, and the absence of the victim as a partner in a plan that was first created for her, and this, on behalf of human rights. In addition, the progressist approach, although present in the interpretation of rules, influenced moreover by political considerations (diplomatic) did not allow this Court to express itself as a real court, including through the protective function of the defendants.
