Content: 〈b〉This open access book unveils Hong Kong's pivotal role in the realm of international economic law. 〈/b〉 Unique to this book is its focus on the interplay between Hong Kong's historical roots and institutional contexts, integrated into its exploration of unilateral, bilateral, and multilateral economic approaches. What sets this book apart is its in-depth treatment of Hong Kong's distinct position as China's Special Administrative Region. It showcases the balance the territory maintains: the autonomy it enjoys, its own robust legal and economic systems, all while being intertwined with broader global interests. Hong Kong's position as China's economic gateway, coupled with its adaptability amidst technological evolutions and international tensions, positions it uniquely in the global economic arena. With the Asia-Pacific economy's rapid evolution and the Greater Bay Area's development, Hong Kong's role is illuminated as increasingly pivotal. This book exposes challenges confronting Hong Kong, from political changes to the ramifications of the National Security Law, while emphasising its continued relevance and growing influence. As Hong Kong threads its path in a globalised world, its prowess in international economic law remains a cornerstone of its identity. Will the territory sustain its prominence amidst evolving challenges and global shifts? The answers lie within, and further research awaits as we track its unfolding narrative. Specifically tailored for academics, diplomats, and researchers in international law, relations, economics and finance, this book offers a vital perspective. Anyone with a vested interest in international economic law and policy will find this comprehensive exploration invaluable. 〈i〉The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com.〈/i〉

Content: Drinking water and wastewater services must be provided to many sectors of a nation's economy, including its industrial, commercial, and residential sectors. This forms the scope of the water industry's activities and it explains why the privatisation of water sanitation and water services has become a huge market and a much-debated issue in a number of jurisdictions. Historically the water industry has been run as a public service which is owned by the local or national government, recent trends suggest that the role of the private sector is increasing. The growing economic interests concerning water and wastewater services are generating a tension with the recent recognition of the human right to water and sanitation. This tension between human right and economic rules is the focus of this book, which reviews all the international rules that form the regulation of global water services.

Content: The first part of this open access book sets out to re-examine some basic principles of trade negotiation, such as choosing the right representatives to negotiate and enhancing transparency as a cure to the public's distrust against trade talks. Moreover, it analyses how the Comprehensive and Progressive Agreement for the Trans-Pacific Partnership (CPTPP) might impact on the Regional Comprehensive Economic Partnership's (RCEP) IP chapter and examines the possible norm setters of Asian IP. It then focuses on the People's Republic of China's (PRC) trade and IP strategy against the backdrop of the power games between the PRC, India and the US. The second part of the book reflects on issues related to investor-state dispute settlement and its relationship with IP, such as how to re-calibrate the balance in international investment arbitration, and whether compulsory license of IP constitutes expropriation in India, the PRC and select ASEAN countries. The third part of the book questions and strives to improve some of the proposed IP provisions of CPTPP and RCEP and to redefine some aspects of international IP norms, such as: pre-grant patent opposition and experimental use exception; patent term extension; patent linkage and data exclusivity for the pharmaceutical sector; plant variety protection; pre-established damages for copyright infringement; and the restructuring of copyright limitations in the public interest. Content: This book analyses actual and potential normative (whether legislative or contractual) conflicts and complex transnational disputes related to state-controlled enterprises (SCEs) operations and how they are interwoven with the problem of foreign direct investment. Moreover, SCEs also fall within the remit of international political economy, international economics and other SCE-related fields that go beyond purely legal or regulatory matters.
Content: In this connection, research on such economic and political determinants of SCE's operations greatly informs and supplements the state of knowledge on how to best regulate cross-border aspects of SCE's and is also be covered in this book. The book also aims to analyse the "SCE phenomenon" which includes a wide panoply of entities that have various structures with different degrees of control by states at the central or regional level, and that critically discuss the above-mentioned overlapping legal economic and political systems which can emerge under various shades of shadows casted by governmental umbrellas (i.e., the control can be exercised through ownership, right to appoint the management, and special-voting-rights). The chapters in this book are grouped, so as to address cross-border investment by and in SCE, into four coherent major parts, namely ---
Content: (i) the regulatory framework of state capitalism: laws, treaties, and contracts; (ii) economic and institutional expansion of state capitalism; (iii) the accountability of state capitalism: exploring the forms of liabilities; and (iv) regional and country perspectives. Contributions address the core theme from a broad range of SCE and international economic regulations, including but not limited to competition law, WTO law, investment law, and financial/monetary law. They also cover the new emerging generation of Free Trade Agreements (EU-Vietnam FTA, EU China investment treaty, Regional Comprehensive Economic Partnership; and the coordination between treaty systems). The book is a valuable addition and companion for courses, such as international trade law, international law of foreign investment, transnational law, international and economic development, world politics, law of preferential trade agreements, international economics, and economics of development

Series Statement: New horizons in international business
Content: In an age of increased necessity for competitiveness of nations and at a time when the world economy is facing recession, this book explores the possible trajectory of ASEAN : arguably one of the most dynamic areas in the world--as a regional economic and political bloc. The expert contributors address the industrial competitiveness of ASEAN and analyse the role of MNEs against the background of the challenges of integration. They illustrate that regional integration will only be a success if ASEAN's linkages are broadened with global partners through negotiations of Free Trade Agreements. The book concludes that although much still remains to be done, and many promises are still to be unveiled, ASEAN's "coming of age" is an historic milestone.
Note: pt. 1. The ASEAN industrial competitiveness challenges within the regional integration process -- pt. 2. The integration of ASEAN in the world economy : the crucial role of FTAs.
