Seit der Kodifizierung des Rechts der gesetzlichen Krankenversicherung im Sozialgesetzbuch, Fünfter Teil, ist zu beobachten, dass der Bund immer häufiger und detaillierter in Regelungsbereiche eingreift, die traditionell der Länderkompetenz unterliegen.
