Thomas Diehn untersucht Rückkehrzusagen beim Betriebsübergang als Rechtsinstitut. Sie können die ihnen zugedachte Funktion, Arbeitnehmer davon abzuhalten, ihr Widerspruchsrecht auszuüben, weitgehend nicht erfüllen. Ein Instrument zur Gestaltung von Betriebsübergängen, das im Individualinteresse zu ineffizienter Verteilung von Ressourcen führt, muß nicht nur restriktiv ausgelegt, sondern auch zurückhaltend eingesetzt werden, am besten gar nicht. -- Individualvertragliche Rückkehrrechte setzen einen freien und geeigneten Arbeitsplatz beim Alt-Arbeitgeber voraus. Zudem besteht mangels Wartezeiterfüllung kein Kündigungsschutz innerhalb der ersten sechs Monate nach Rückkehr. Kollektive Rechtsgrundlagen kommen nur sehr eingeschränkt in Betracht. Insbesondere können Rückkehrzusagen betriebsverfassungsrechtlich nicht wirksam begründet werden, mangels sachlich-funktioneller und personeller Zuständigkeit des Betriebsrats.
