Auch wenn die Erbschaftsteuer europarechtlich nicht harmonisiert ist, müssen die nationalen Gesetzgeber der EU-Mitgliedstaaten bei ihrer Ausgestaltung der Erbschaftsteuer, sofern sie sich für eine Erhebung entschieden haben, das Europarecht beachten und dürfen nicht dagegen verstoßen. In dieser Arbeit werden die Vorgaben sowohl des Europarechts als auch des deutschen Verfassungsrechts für die Ausgestaltung der beschränkten Erbschaftsteuerpflicht herausgearbeitet und die deutschen Regelungen daran gemessen. Insgesamt werden dabei 18 verfassungs- und/oder europarechtswidrige Regelungen des ErbStG identifiziert und entsprechende Änderungsvorschläge unterbreitet. Darüber hinaus wird rechtsvergleichend an jeweils passender Stelle ein Blick auf die Regelungen der anderen Staaten des EWR geworfen. Dafür finden sich in einem Anhang mehrere Übersichten, die einen Vergleich der Ausgestaltung der Erbschaftsteuer in den Staaten des EWR sowie Großbritannien ermöglichen sollen. / »The Conformity of Limited Inheritance Tax Liability with Constitutional and European Law«: In this thesis, the requirements of European law and German constitutional law for the establishment of limited inheritance tax liability are identified and analyzed and the German regulations are evaluated. A total of 18 provisions of the German Inheritance Tax Act that are contrary to constitutional and/or European law are identified and appropriate amendments are proposed. In addition, a comparative analysis of the regulations of other EEA states is provided in the relevant sections.
