Die Dissertation kommt zum Ergebnis, dass verschiedene Arten geschlossener Fonds grundsätzlich unter das Kapitalanlagegesetzbuch (KAGB) fallen. Namentlich werden geschlossene Immobilienfonds, Schiffsfonds, Windfonds, Projektentwicklungsfonds und Private Equity Fonds untersucht. Die Eröffnung des Anwendungsbereichs des KAGB hängt davon ab, ob die jeweilige Vermögensanlage ein Investmentvermögen im Sinne des § 1 Abs. 1 S. 1 KAGB darstellt. Der Schwerpunkt dieser Arbeit liegt auf der Untersuchung der einzelnen Tatbestandsmerkmale des Investmentvermögens. Insbesondere in Bezug auf das Tatbestandsmerkmal «kein operativ tätiges Unternehmen außerhalb des Finanzsektors» bestehen erhebliche Rechtsunsicherheiten. Diese Arbeit trägt dazu bei, diese Unsicherheiten zu reduzieren.
