An der Frage, ob vertragliche Ansprüche gegen unwillige Schuldner »in natura« durchsetzbar sein sollten oder der Gläubiger sich letztlich mit Schadensersatz begnügen muss, scheiden sich die Geister und die Rechtskreise. Bei der Vereinheitlichung des Vertragsrechts ist der Erfüllungszwang daher ein kritischer Punkt. Nach einem einführenden rechtsgeschichtlichen Abriss stellt die Arbeit die konträren Positionen des heutigen Civil Law (grundsätzlich Erfüllungszwang) und des Common Law (grundsätzlich nur Schadensersatz) gegenüber. Der weitere Rechtsvergleich umfasst ausgewählte Rechtsordnungen, Einheitsrechte und Vereinheitlichungsvorschläge. Den Hauptteil bildet eine Abwägung verschiedener Positionen unter Berücksichtigung des Wesens und der Funktion von Verträgen. Die kritische Würdigung der ethischen, moralischen, soziologischen und ökonomischen Traditions- und Argumentationslinien mündet in einem eigenen Regelungsvorschlag zum Erfüllungszwang in einem vereinheitlichten Vertragsrecht. / »Specific Performance – A Historical and Comparitive Analysis with a View to the Unification of Contract Law« -- Specific performance is a key issue in the unification of contract law. The author provides a historical and comparative analysis covering a range of jurisdictions and uniform laws, discussing the theoretical underpinnings of the different approaches found. A critical assessment of the relevant sociological, economical, religious and moral arguments finally leads to a proposal for a set of rules on specific performance in a unified contract law.
