Soziale Dienstleistungen zählen wie die Gesundheitsdienstleistungen nach europäischem Recht zu der sog. "Dienstleistungen von allgemeinem Interesse". Diese sind zu großen Teilen von der "Dienstleistungsrichtlinie" ausgenommen, sie unterliegen aber den anderen europäischen Wettbewerbsregeln. Problematisch ist aus Sicht der sozialen Anbieter, dass ohne sektorielle Richtlinie keine Rechtssicherheit vorliegt, und dass sie sich einer Konkurrenz mit niedrigen Qualitätsstandards und niedrigen Löhnen ausgesetzt sehen. Auch bringen die Regeln bezüglich der staatlichen Subvetionierungen zusätzliche Schwierigkeiten mit sich. Doch die Akteure der Zivilgesellschaft, unter denen auch die Anbieter sozialer Dienstleistungen zu finden sind, beurteilen das unterschiedlich, und nicht alle ziehen am selben Strang; die Interessenlage scheint nicht immer eindeutig zu sein. Als Königsweg könnte es sich erweisen, die Partizipation der Klienten in den Mittelpunkt zu stellen; auch auf Seiten der sozialen Anbieter kann das einen deutlichen Mehrwert bewirken.
