In private decisions, old habits die hard: families continue to allocate resources disproportionately to benefit boys and men. Meanwhile, the legal profession remains in thrall to assumptions that reinforce gender inequality. Bessière and Gollac marshal a range of economic data documenting these biases. They also examine scores of family histories and interview family members, lawyers, and notaries to identify the accounting tricks that tip the scales in favor of men.Women across the class spectrum-from poor single mothers to MacKenzie Scott, ex-wife of Amazon billionaire Jeff Bezos-can face systematic economic disadvantages in divorce cases. The same is true in matters of inheritance and succession in family-owned businesses. Moreover, these disadvantages perpetuate broader social disparities beyond gender inequality. As Bessière and Gollac make clear, the appropriation of capital by men has helped to secure the rigid hierarchies of contemporary class society itself.

    Content: De plus en plus répandue mais toujours distinctive, et transmissible, la propriété immobilière participe du statut social des individus et de leurs groupes de parenté. Le marché immobilier se trouve pris dans les stratégies familiales de reproduction. Pour examiner ces stratégies immobilières familiales et leur cadre juridique, la thèse combine exploitation statistique de données nationales et monographies de familles. S'il s'est historiquement imposé, le modèle de l'achat conjugal du logement n'est pas synonyme d'éloignement de la famille d'origine, ni accessible à tous. En milieux populaires, le recours au bien hérité est parfois la seule accumulation possible, qui ancre localement. Pour des personnes plus favorisées, l'achat du logement autorise une mobilité géographique favorable aux carrières ascendantes sans empêcher la conservation d'une maison de famille. Les enfants uniques, les aînés et les garçons héritent plus souvent des biens immobiliers familiaux, mais les aînés profitent de ce patrimoine plus tard que les cadets. C'est surtout pour les femmes que l'accumulation immobilière dépend de la mise en couple. La répartition de la propriété entre conjoints et la localisation de leur logement par rapport aux groupes d'origine dépendent à la fois de leurs situations professionnelles respectives et des capitaux de leurs familles. L'usage de moyens juridiques pour réguler les situations immobilières se cantonne aux milieux indépendants ou fortement dotés. Les tensions engendrées par ces situations immobilières dans le couple et entre germains témoignent de la violence des mécanismes de reproduction des rapports sociaux de classe et de sexe qui traversent la famille
    Content: House ownership, becoming more frequent but still staying distinctive, notably with the possibility to transmit to future generations, constitutes an important part of the social status of individuals and their kinship groups. The real estate market is entangled into strategies of social reproduction of families. In order to examine these strategies and their juridical framework, this thesis combines statistical research on national data and monographic ethnography of families. The model of conjugal house's purchase, who has historically imposed itself, is not accessible to everyone and not often synonymous with a special separation from the family of origin. In working classes, inheritance is most of the time the only way to acquire a house, and determines its locality. The wealthier can combine the purchase of a main residence and the preservation of a family house, which allows a geographic mobility, which favors rising professional trajectories. Whatever the social background, it is the single children, the eldest and the boys who inherits often the family real estate, but the eldest profit later from these assets. Women depend on the formation of the couple to acquire real estate. The division of property between the spouses and the residential situation compared to their kinship groups depend on their own professional situations and wealth of their families. The use of juridical tools to regulate housing situations is limited to self-employed and very wealthy classes. The tensions which arise from housing situations in couples and between siblings witness the violence of the mechanisms of reproduction of class and gender relations which are inherent in the family

Le foyer est alors un espace essentiellement féminin tandis que les hommes investissent les lieux extérieurs et la sphère professionnelle selon la division traditionnelle du travail. Cette organisation sociale évolue au cours du XXe siècle avec les changements qui s’opèrent dans la famille et le monde professionnel. La généralisation du travail salarié des femmes, les recompositions familiales, le développement de la propriété (occupante ou de rapport), les nouvelles formes de domesticité et d’emplois à domicile, transforment à la fois le rapport à l’habitat et les relations de pouvoir entre les sexes qui se jouent dans la sphère domestique. Considérant le logement dans ses dimensions à la fois matérielle, économique, juridique et symbolique, cet ouvrage ouvre de nouvelles pistes de recherche sur la sphère domestique. L’habitat doit ainsi être perçu comme un révélateur des changements et des permanences des rapports sociaux de sexe dans la société française contemporaine.
