Die Autorin überprüft das deutsche Strafrecht auf seine Eignung zur Erfassung einer Kriminalitätsform, die in der angloamerikanischen Rechtswissenschaft als »Image-based sexual abuse« bezeichnet wird und zu deren Erscheinungsformen diverse bildbasierte sexualisierte Belästigungen (z. B Sextortion, Upskirting, Revenge Porn) zählen. Die Abhandlung unternimmt eine phänomenologische und strafrechtsdogmatische Betrachtung des sog. Image-based sexual abuse und zeigt auf diese Weise Unzulänglichkeiten bei der gegenwärtigen Strafbarkeit von bildbasierten sexualisierten Belästigungen nach dem deutschen Strafrecht auf. Gemessen an verfassungsrechtlichen, völkerrechtlichen und empirischen Leitlinien, empfiehlt die Autorin einen § 184k StGB-E (Bildbasierte sexualisierte Belästigung). Dieser normiert einen einheitlichen Straftatbestand gegen diverse bildbasierte sexualisierte Belästigungen und berücksichtigt eine Verknüpfung mit häufigen Begleithandlungen (wie z. B. Hacking, Doxing) strafschärfend. / »Liability for Image-Based Sexual Harassment. A Phenomenological and Criminal Analysis of so-called Image-Based Sexual Abuse«: The thesis includes a phenomenological and criminal analysis of so-called image-based sexual abuse. In this way, the author shows discrepancies in the current liability for various imagebased sexual harassment (e.g. revenge porn, upskirting, sextortion, deep-fake pornography) under German criminal law. Based on this, the author proposes a future legislative proposal for German criminal law.
