This volume presents the five major enemy combatant cases of the post-9/11 era. Assembled in narrative form, the documents tell the story of the legal arguments upon which the U.S. government and the defense attorneys have based their respective sides in what has become a complex and philosophically important debate among American lawyers, academics, and citizens. These cases involve two U.S. citizens, one Qatari citizen enrolled at an Illionois university, and two of the most prominent cases regarding Guantanamo detainees. Viewed together, the documents assembled herein in digested form illustrate the judicial struggle between the needs of national security and the constitutional and international legal protections regarding the rights of individuals. Legal issues, including habeas corpus, presidential powers, and the applicability of the Geneva Conventions; administrative issues such as the plenary executive and the roles of the Department of Defense, State, and Justice; and moral questions, including conditions of detention and how to define the "enemy", all coalesce in providing one of the most comprehensive and compelling portraits of the U.S. engagement in the war of terror.
