Die Akzessorietät, eines der grundlegenden Prinzipien des Kreditsicherungsrechts, bezeichnet die Abhängigkeit eines Sicherungsrechts wie etwa der Bürgschaft, der Hypothek oder des Pfandrechts von der gesicherten Forderung. In der Arbeit wird die Entwicklung dieses Akzessorietätsgrundsatzes vom römischen Recht über das preußische Recht im 18. und 19. Jh. bis zum BGB untersucht. Dabei werden insbesondere auch die sog. nicht-akzessorischen Sicherungsrechte des BGB in den Blick genommen. -- Obgleich sich schon im römischen Recht ansatzweise ein Akzessorietätsverständnis zeigt, wurde die Akzessorietät nicht als Prinzip tradiert, sondern ist als Grundsatz erst in der Lehre des 19. Jh. entstanden. Anders als bisher angenommen sah der historische Gesetzgeber des BGB in der Akzessorietät keinen strengen und ausnahmslosen, sondern einen flexiblen Grundsatz, der es ermöglicht, Sicherungsrechte unterschiedlich stark mit der zu sichernden Forderung zu verknüpfen. / »The Principle of Accessoriness in Security Rights« -- Accessoriness is one of the fundamental principles of security law. It denotes the dependence of a security right like mortgage, guarantee or lien on the secured claim. This postdoctoral thesis examines the development of the principle of accessoriness from Roman law to Prussian law in the 18th and 19th century up to the German Civil Code (BGB). A main focus is set on the non-accessory security rights.
