E. T. A. Hoffmann war in der Zeit der Entstehung der meisten seiner literarischen Werke als Richter am Kammergericht in Berlin tätig. Die Arbeit macht sich auf die Spurensuche bezüglich der Zusammenhänge zwischen dichterischem Schaffen und richterlicher Tätigkeit. Themen wie psychische Erkrankungen von Delinquenten, der Übergang vom Inquisitions- zum Akkusationsverfahren, das Recht des Königs zum letzten Wort, Folter und Giftmord, mit denen Hoffmann sich in richterlicher Tätigkeit zu befassen hatte, spiegeln sich mannigfaltig in den Erzählungen des Dichters wider. Dies wird insbesondere am Beispiel der Kriminalerzählung Das Fräulein von Scuderi nachgewiesen. In Meister Floh legt Hoffmann die Einmischungsversuche der ministeriellen Bürokratie in laufende Gerichtsverfahren und deren Forderung zur Bestrafung der Gesinnung bloß und bekundet ein neues Selbstverständnis vom Richteramt.
