Die Arbeit befasst sich mit der Reichweite von Bürgerbegehren in der Bauleitplanung. Dabei liegt der Fokus auf jenen Bürgerbegehren, die nicht unmittelbar unter den bauleitplanerischen Ausschlusstatbestand fallen. Diese Fragestellungen mit Bezug zur Bauleitplanung wurden von den Gerichten vielfach als Versuch der Umgehung des Ausschlusstatbestandes und damit als unzulässig bewertet. Vor diesem Hintergrund wird untersucht, ob thematisch die Bauleitplanung berührende Themen sowie Fragen im Vorfeld der Planung und der Planverwirklichung dem bauleitplanerischen Ausschlusstatbestand unterfallen müssen. Die Bewertung erfolgt aus bauleitplanerischer Perspektive sowie unter dem Aspekt des Vorrangs des Gemeinderats wie er in Art. 28 Abs. 1 Satz 2 GG zum Ausdruck kommt. Die Arbeit schließt mit einem Verordnungsvorschlag über die Zulässigkeit von Bürgerbegehren an der Schnittstelle zur Bauleitplanung. / »The Exclusion Clause of Urban Land-Use Planning and Attempts of Bypassing« -- The study examines the scope of citizens' petitions in urban land-use planning. It will be evaluated whether topics affecting urban land-use planning as well as questions in the run-up to planning and plan implementation must fall under the exclusion of urban land-use planning. The evaluation takes place from the perspective of urban land-use planning and the priority of the local council as expressed in Article 28 (1) sentence 2 of the Basic Law. It concludes with a proposal for a regulation.
