Content: Wem geschieht - normativ betrachtet - eigentlich Kriminalunrecht? Nach vorherrschender Auffassung in der Strafrechtswissenschaft ist es nicht das faktisch verletzte Opfer, sondern die staatlich verfasste Rechtsgemeinschaft. Das Opfer ist so bloß die »Leinwand«, auf der sich das Unrecht zwischen Täter und Staat abspielt. Die Arbeit argumentiert demgegenüber für einen strafrechtlichen Paradigmenwechsel, um Verbrechen als Verletzung individueller Rechte und zugleich der Rechtsgemeinschaft zu begreifen. Mit einem interdisziplinären Zugang weist es anhand des geltenden Strafrechts die Verletzung subjektiver Rechte von Verbrechensopfern als Wesenselement des Kriminalunrechts aus. Diese neue Theorie des Verbrechens liefert nicht nur ein neues Fundament für eine normativ eigenständige, emanzipierte Stellung der Opfer im Strafrecht, sondern bietet auch einen strafrechtsimmanenten, kritischen Maßstab für die Betrachtung des materiellen Strafrechts, der Straftheorie sowie des Strafverfahrens. / »The Wrongfulness of Crimes. On Rights and Rights Violations in Criminal Law«: The thesis challenges a common view in criminal law theory, which understands criminal wrongdoing as offences against the state. Instead, the author proposes a paradigm shift arguing that crimes are conceivable as intersubjective right violations and simultaneously as violations of the legal community. Thus, the book provides the foundation for a better understanding of the role of victims in criminal law and an innovative critical standard for evaluating criminal law and criminal procedure.

Content: 1797 erscheint mit den Metaphysischen Anfangsgründen der Rechtslehre Immanuel Kants rechtsphilosophisches Hauptwerk. Nicht selten begegnet man daher der Auffassung, Kants Rechtsphilosophie entstamme im Wesentlichen seiner Spätphase und sei überdies nur schwer mit der kritischen Moralphilosophie der 1780er Jahre in Einklang zu bringen. Vor diesem Hintergrund widmet sich die vorliegende Untersuchung dem Vergleich des kantischen Rechtsbegriffs, wie er 1797 in der Einleitung in die Rechtslehre vorgestellt wird, mit Kants Ausführungen in den Vorlesungsnachschriften Moral-Mrongovius II und Naturrecht-Feyerabend aus dem Jahre 1784. Dabei kann nachgewiesen werden, dass der Rechtsbegriff von 1797 bereits 1784 ausgearbeitet war. Mehr noch: Es zeigt sich, dass Kants Rechtsbegriff nicht nur bereits in der Phase seiner kritischen Moralphilosophie vorlag, sondern vielmehr in einem Guss mit ihr konzipiert wurde und wie diese auf dem kritischen Freiheitsbegriff basiert.

Content: The Proceedings present the contributions to the 13th International Kant Congress which was held at the University of Oslo, August 6-9, 2019. The congress, which hosted speakers from more than thirty countries and five continents, was dedicated to the topic of the court of reason. The idea that reason stands before itself as a tribunal characterizes the whole of Kant's critical project. Without such a court, reason falls into conflict with itself. With such a court in place, however, it may succeed in establishing the possibility and limits of metaphysics, ethics, aesthetics, law and science. The idea of reason being its own judge is not only pivotal to a proper understanding of Kant's philosophy, but can also shed light on the burgeoning fields of meta-philosophy and philosophical methodology. The 2019 Kant Congress put special emphasis on Kant's methodology, his account of conceptual critique, and the relevance of his ideas to current issues in especially political philosophy and the philosophy of law. Additional sections discussed a wide range of topics in Kant's philosophy. The Proceedings will provide anyone who is interested in exploring the variety of present-day work on Kant and Kantian themes with a wealth of fruitful inspiration.

Content: 1797 erscheint mit den Metaphysischen Anfangsgründen der Rechtslehre Immanuel Kants rechtsphilosophisches Hauptwerk. Nicht selten begegnet man daher der Auffassung, Kants Rechtsphilosophie entstamme im Wesentlichen seiner Spätphase und sei überdies nur schwer mit der kritischen Moralphilosophie der 1780er Jahre in Einklang zu bringen. Vor diesem Hintergrund widmet sich die vorliegende Untersuchung dem Vergleich des kantischen Rechtsbegriffs, wie er 1797 in der Einleitung in die Rechtslehre vorgestellt wird, mit Kants Ausführungen in den Vorlesungsnachschriften Moral-Mrongovius II und Naturrecht-Feyerabend aus dem Jahre 1784. Dabei kann nachgewiesen werden, dass der Rechtsbegriff von 1797 bereits 1784 ausgearbeitet war. Mehr noch: Es zeigt sich, dass Kants Rechtsbegriff nicht nur bereits in der Phase seiner kritischen Moralphilosophie vorlag, sondern vielmehr in einem Guss mit ihr konzipiert wurde und wie diese auf dem kritischen Freiheitsbegriff basiert.
