Der Immobilienerwerb hat große praktische Bedeutung für die Verwirklichung des EG-Binnenmarktes, namentlich für die Ausübung der Grundfreiheiten. Neben dieser wirtschaftlichen Funktion spielt er eine wichtige Rolle für die soziale und politische Integration der Unionsbürger in den Mitgliedstaaten. Der Autor untersucht die sehr querschnittsartig geregelte Materie des Immobilienerwerbs im Recht der Europäischen Union. Die Voraussetzungen des Erwerbs und die Möglichkeiten seiner Beschränkung durch nationale Immobilienerwerbsgesetze werden eingehend analysiert. Oft besteht ein Spannungsfeld zwischen der Liberalisierung des Immobilienmarktes und der Verfolgung nationaler Interessen, etwa bei Belangen der Raumordung oder des Umweltschutzes. Ansätze zu einer europarechtskonformen Lösung derartiger Konflikte werden aufgezeigt. Im Zuge der Osterweiterung entfachte die Liberalisierung des Grundstücksverkehrs sehr kontroverse Diskussionen in einigen Beitrittsländern. Dies führte zu diversen Sonderregelungen, auf deren Grundlage der Immobilienerwerb durch (EU-)Ausländer dauerhaft oder zeitweise eingeschränkt werden darf. Der Autor analysiert diese Regelungen und klärt ihre praktische Relevanz.
