I. Die vorliegende Arbeit ist das Schlußstück einer fünfgliedrigen Kette rechtstheoretischer Untersuchungen. Bei der ersten Untersuchung (1925) handelte es sich darum, Genesis und Grenzen der Rechtsgeltung in vorläufigen Überlegungen zu bestimmen. Nachdem eine erste rohe Skizze der Theorie des Rechtskreises entworfen war, konnte der Sprung in die Mittelpunktsproblematik des rechtlich vergemeinschafteten Menschen gewagt werden. Es ist eine die Rechtssubjektivität isolierende Betrachtung, die ich in der zweiten Untersuchung (Rechtssubjekt und Rechtsperson 1927) der Öffentlichkeit vorgelegt habe. Im Jahre 1929 folgte eine kleinere Arbeit (Recht und Welt), die, am personalen Ausgangspunkt festhaltend, den Weltbezug des Menschen, der Rechtspersonalität besitzt, zum besonderen Gegenstand hat. Wie erschließt sich dem Menschen die Welt des Rechts, wie muß er sich verhalten, damit Rechtliches für ihn "da" sei und wirklich werde in seinem Lebensraum? - so lautete damals die Fragestellung. Das Grundthema der beiden voraufgegangenen Untersuchungen, "Der Mensch im Recht", ist zwei Jahre später in einer neuen Wendung aufgenommen worden (Negatives Sollen 1931). Die statische Betrachtungsweise der zweiten Untersuchung wird von einer dynamischen Einstellung zum Rechtssubjekt, dessen rechtsregionales Verhalten nun den Erkenntnisgegenstand bildet, abgelöst. Die vierte Untersuchung hat es mit der Einwirkung des Rechts auf die Willenszukunft des Menschen zu tun. Er tritt als Adressat von Sollenssätzen vor unser geistiges Auge. Das Individuum, das etwas: so sich (nicht) verhalten soll, ist aber zugleich ein Mensch, der etwas: auf die soziale Welt gestaltend einzuwirken vermag
