Kann Strafverfolgung opferorientiert sein? Spektakuläre Prozesse um sexuellen Missbrauch von Kindern haben diese Frage aufgeworfen. Der Autor zeigt eine Möglichkeit, wie sich ein Widerspruch zwischen öffentlichem Strafverfolgungsinteresse und der Berücksichtigung des Opfers als Rechtssubjekt vermeiden lässt. Opferschutz im Strafverfahren besteht nicht in Vergeltung oder Genugtuung, sondern darin, dem Opfer eine Rechtsposition einzuräumen, die es ihm ermöglicht, mit seiner Geschichte des erlittenen Unrechts gehört zu werden. -- Ausgehend von empirischen Befunden wird argumentiert, dass sowohl ein besserer Schutz der Rechtsgüter als auch die Respektierung des kindlichen Opferzeugen rechtspolitisch, verfassungsrechtlich und strafrechtstheoretisch geboten ist. Dies ist aber nur dann realisierbar, wenn es gelingt, den Täter von einer konfrontativen Verteidigung abzuhalten. Bei einer Vorverlagerung der Beweiserhebung in das Ermittlungsverfahren ergibt sich eine Möglichkeit, einerseits den kindlichen Opferzeugen zu schützen und andererseits ein Angebot für den Täter vorzubereiten, das diesen zu einem Einlenken bewegen kann. Ein sinnvolles Angebot besteht in einer Psychotherapie, die anstelle der Strafe als Auflage verhängt wird. -- Mit Hilfe dieser Alternative ist eine funktionsfähige Strafrechtspflege zu erwarten, da sie Opfern und Tätern einen ersten Schritt zu einem konstruktiven Umgang mit der Tat ermöglicht, anstatt nur auf Verfolgung und Strafe zu setzen.
