Le droit au procès équitable est aujourd'hui le coeur de la procédure pénale, à tel point que même le Code d'instruction criminelle est en passe d'être remodelé à l'aune de cette exigence par la Cour constitutionnelle. Pour arriver à cette conclusion, Olivier Michiels, après avoir souligné l'évolution remarquée du catalogue constitutionnel belge des droits fondamentaux à la suite de la mutation des droits et libertés garantis par les instruments internationaux, met en évidence l'ingéniosité juridique dont la Cour a fait preuve pour étendre son analyse au-delà de la vision manichéenne de la constitutionnalité. Ensuite, il s'attèle à une analyse minutieuse et instructive des arrêts prononcés par la Cour constitutionnelle en matière de procédure pénale. À l'issue de cette étude d'envergure, l'auteur dégage un certain nombre de prises de position répétées de la Cour constitutionnelle qui s'imposent comme autant de "fondamentaux" jalonnant l'ensemble de la procédure pénale. C'est ainsi qu'en procédant par touches successives et systémantiques, l'auteur observe que le critère phare du raisonnement de la Cour constitutionnelle devient celui de l'équité du procès, tout en relevant que la procédure répressive reste encadrée par le principe de légalité. Il montre comment le recours au droit au procès équitable - notion éminemment floue - comme critère ultime de l'interprétation de la procédure pénale peut se concilier avec la rigueur requise en cette matière, mais laisse aussi entrevoir que le système juridique lui-même pourrait s'en trouver profondément modifié.
