Die Frage nach dem Verhältnis von Recht und Gerechtigkeit ist die wesentliche Frage der Rechtsphilosophie.Kann beides unabhängig voneinander betrachtet werden, wie es die positivistische Trennungsthese behauptet? Der Autor ist dezidiert anderer Ansicht und versucht die Frage unter Rückgriff auf einen Klassiker, nämlich die Abhandlung zur Gerechtigkeit im fünften Buch der Nikomachischen Ethik des Aristoteles zu beantworten.In neun rechtlichen Argumentationsfiguren untersucht er, inwiefern die aristotelischen Argumente noch heute von Interesse sind – inwieweit sie dem Recht als immanente Wertungen zu Grunde liegen und inwieweit sie in der täglichen Rechtspraxis Anwendung finden. Dabei folgt der Autor dem Aufbau des antiken Textes und stellt den darin enthaltenen Gedanken aktuell geltendes Recht gegenüber. Ausgehend von einer Diskussion der berühmten Mesotes-Lehre werden so Fragen der Zurechnung, der Methodenlehre und des Verhältnisses von Natur- und Gesetzesrecht behandelt
