Mit dem »Gnadenschuss« an Schwerstverwundeten in bewaffneten Konflikten behandelt diese Arbeit einen Bereich der aktiven Sterbehilfe, der bisher kaum Beachtung gefunden hat. Nach einer umfassenden Darstellung praktischer Fälle aus Geschichte und Gegenwart und einer Erläuterung der maßgeblichen Regeln des humanitären Völkerrechts erfolgt eine Prüfung hypothetischer »Gnadenschuss-Fälle« mit Beteiligung deutscher Soldaten nach den jeweils einschlägigen Tatbeständen (§ 216 Abs. 1 StGB; § 8 Abs. 1 Nr. 1 VStGB). Untersucht werden verschiedene denkbare Lösungsansätze für solche Fälle, bevor ein eigener Vorschlag unter Heranziehung des rechtfertigenden Notstands erarbeitet wird. Anschließend werden die Folgefragen, die sich aus der vorgeschlagenen Notstandslösung ergeben, erläutert. Die Arbeit schließt mit einem Überblick über weitere denkbare Fallkonstellationen im Kontext militärischer Extremsituationen und einer tabellarischen Zusammenstellung der bekanntgewordenen »Gnadenschuss-Fälle«. / »Mercy Killing on the Battlefield. On Active Euthanasia in Extreme Combat Situations«: With the »mercy killing« of severely wounded soldiers in armed conflicts, this dissertation covers an area of active euthanasia that has received almost no attention to date. Based on a comprehensive presentation of historical cases, and taking into account the applicable rules of international humanitarian law, this study examines such »mercy killing« cases under the relevant provisions of the German Criminal Code (StGB) and the German Code of Crimes against International Law (VStGB).
