Zu dem Thema, das im Folgenden behandelt wird, habe ich zweimal in der Geisteswissenschaftlichen Klasse der Nordrhein-Westfälischen Akademie der Wissenschaften vorgetragen, in jeweils abgewandelter Perspektive. Im vorliegenden Text sind beide Vorträge zusammengefaßt, wobei Wiederholungen zu beseitigen waren. Andererseits sind Ergänzungen zugefügt, insbesondere der Rückblick auf die Vorgeschichte, die im mündlichen Vortrag nicht mehr Platz finden konnten, und außerdem sind Diskussionsbeiträge berücksichtigt, die im Anschluß an beide Vorträge gebracht wurden. Diese Erweiterungen sollen nicht den Charakter eines Vortrages ändern, der sich an ein gelehrtes, aber nicht ein spezialistisches, sondern interdisziplinär zusammengesetztes Auditorium wendet. Bei diesem darf man eine fundierte Allgemeinbildung voraussetzen, welche unter dem Titel "Naturrecht" auch eine Vorstellung von der bedeutenden Rolle des Thomas von Aquin für diese Doktrin umfaßt. Freilich ist diese Vorstellung zumeist durch das Bild eines Thomismus der Schule geprägt, der Thomas durchgehend "metaphysisch" las, der das "Sollen" aus dem "Sein" begründen wollte, und dies nicht zuletzt unter dem Eindruck der neuzeitlichen Naturrechtslehren. Hier setzte vielfach die Kritik an, aber es gab auch eine Anhängerschaft, die in einem metaphysisch gesicherten Naturrecht eine Kontrollinstanz gegen eine positivistische Rechtspraxis sah. Erstaunlich ist, daß eine solche Vorstellung immer noch recht verbreitet ist, obwohl es seit Jahrzehnten eine Forschung gibt, die ein wesentlich modifiziertes Bild von der authentischen Doktrin des Thomas von Aquin erarbeitet hat
