Das "Recht der Minderheiten" geht weit über dasjenige hinaus, was üblicherweise mit dem Stichwort Minderheitenschutz verbunden wird. Es erfaßt jede Gruppe von Menschen, die sich innerhalb eines adäquaten Bezugsrahmens durch ein nicht nur zufällig gegebenes gemeinsames Merkmal von den übrigen Menschen unterscheidet und zahlenmäßig unterlegen ist. Der Kennzeichnung der in Betracht kommenden Phänomene folgt die Grundlegung und die Begrenzung des Minderheitenschutzes. -- Zur Vermeidung von Konflikten zwischen Mehrheit und Minderheit ist die Anerkennung eines Minimums an Minderheitenrechten durch die Mehrheit ebenso unerläßlich wie die Einsicht, daß die Gewährung von Minderheitenrechten nur innerhalb bestimmter Grenzen erfolgen kann. Minderheitenschutz erfolgt überwiegend im Rahmen staatlicher Abwägungsprozesse. Hier ist für konkrete Personengruppen auf der Grundlage ihrer charakteristischen Legitimation als Minderheit und der dazu gehörenden Grenzen eine angemessene Entscheidung zu treffen.
