Rechtsregeln sorgen dafür, daß menschliches Handeln voraussehbarer wird. Aus ökonomischer Sicht sollten sie außerdem die gesellschaftliche Wohlfahrt maximieren, also effizient sein. -- Der Autor untersucht Haftungsregeln aus dem amerikanischen Recht der unerlaubten Handlung. Welcher Mechanismus sorgt nun dafür, daß Rechtsregeln effizient sind? Ist es der anonyme Markt, in dem zwei widerstreitende Parteien und ein zur Zufallsmaschine degenerierter Richter nach effizientem Recht streben? Es wird gezeigt, daß das Recht dann nur unter sehr restriktiven Bedingungen zu höherer Effizienz führt. Auch wenn ein Richter, also die sichtbare Hand, in einem Prozeß beteiligt ist und versucht, effizientes Recht zu sprechen, strebt das Recht (der unerlaubten Handlung) nur in bestimmten Fällen zu höherer Effizienz. -- Im letzten Teil der Arbeit wird die in der Ökonomie übliche Annahme aufgegeben, daß die Entscheidungsträger perfekt rational handeln. Es wird angenommen, daß Richter bei der Verarbeitung von Informationen Fehler begehen, und untersucht, unter welchen Bedingungen das Recht dann zu höherer Effizienz strebt. Es wird gezeigt, daß durch die Anwendung einer Rechtsinterpretationsregel - der stare decisis-Doktrin - bessere, also effizientere Ergebnisse erzielt werden, als wenn ein imperfekter Richter sich wie ein perfekt rationaler Richter verhalten wollte. Die Arbeit hat somit zwei Botschaften. Erstens: Recht evolviert weder durch eine sichtbare noch durch eine unsichtbare Hand notwendigerweise zu höherer Effizienz. Zweitens: Menschen (Richter) mit imperfekten Entscheidungsfähigkeiten fahren in bestimmten Situationen besser, wenn sie nicht das Verhalten des kognitiven Supermanns kopieren, sondern zu einfachen Daumenregeln oder Rechtsinterpretationsregeln greifen.
