In den vergangenen Jahren wurden die Eingriffsgrundlagen in den Polizeigesetzen erheblich ausgedehnt. Mit der polizeilichen Arbeit zur Gefahrenabwehr geht ein erhöhtes Informationsaufkommen einher, wobei sich die Frage nach der strafprozessualen Verwertbarkeit dieser Informationen anschließt. -- Der Informationsanfall läßt sich qualitativ und terminologisch in drei Arten kategorisieren: Absichts-, Zufalls- und Begleitfund. Aufgrund der Streubreite vieler Eingriffsmaßnahmen, wie etwa beim Abhören einer Wohnung, ist eine beiläufig erlangte, strafrechtlich aber bedeutsame Information in so vielen Fällen Begleiterscheinung, daß sie nicht mehr als zufällig angesehen werden kann. Nach dem Prinzip "Zufall und Notwendigkeit" wird aus dem bei isolierter Betrachtung zufälligen Fund bei gesamtheitlicher Sichtweise ein "Begleitfund". Als Produkt technischer Unzulänglichkeit ist er für die Abwehr der ermittelten Gefahr irrelevant - eigentlich müßte er in einem "Informationsfilter" hängenbleiben. Weist ein solcher Begleitfund auf eine begangene Straftat hin, so stellt sich die Frage, ob und in welchem Umfang er strafverfahrensrechtlich genutzt werden darf. Mangels Tatverdachts wäre seine Erhebung nach den Vorschriften der StPO jedenfalls nicht möglich gewesen. -- Die Autorin untersucht das bisher unerkannte Problem, ob es eine nicht mehr zu rechtfertigende Überinanspruchnahme des einzelnen darstellt, wenn eine gefahrenabwehrrechtliche Maßnahme - in vorhersehbarer Weise - zur eigenen Strafverfolgung führt. Im Ergebnis ist hier gesetzgeberischer Handlungsbedarf angezeigt.
