Das Europäische Agenturwesen wird seit seinen Anfängen Mitte der siebziger Jahre wie kein anderes Phänomen der EU-Eigenverwaltung am Prinzip des institutionellen Gleichgewichts gemessen. Mit der Errichtung der Europäischen Bankenaufsichtsbehörde (EBA) und ihrer Anpassung an die Bankenunion im Euroraum hat die Kontroverse um die Vereinbarkeit des Agenturmodells mit dem institutionellen Gleichgewicht noch einmal an Dynamik gewonnen. -- Die Autorin untersucht grundlegend den Umfang und die Grenzen der Zulässigkeit der Errichtung europäischer Agenturen am Maßstab des Prinzips des institutionellen Gleichgewichts. Besonderer Wert wird dabei auf die Bedeutung der »unabhängigen europäischen Verwaltung« gelegt, zu der sich die Verträge in Art. 298 AEUV deutlich bekennen. Als beispielhafter Untersuchungsgegenstand wird die EBA gewählt. Die Autorin kommt zu dem Ergebnis, dass die Delegation von Befugnissen in Anbetracht der hohen Unabhängigkeit der Behörde nicht vollumfänglich mit dem Prinzip des institutionellen Gleichgewichts vereinbar ist.
