In der Verfassungstheorie gilt die Judikative als die »schwache Gewalt“. Um sich im öffentlichen Gewaltengefüge Gehör zu verschaffen, können sich Gerichte allein auf ihre Autorität berufen. Diese Autorität wird durch die anderen Gewalten jedoch zunehmend auf die Probe gestellt.
